Successes With OSHA and Legal
Cases
In FY 2004, OSHA issued more than
86,708 violations and levied fines of more than $166
million. We have been highly sucessful in handling OSHA cases
that have resulted in hundreds of thousands of dollars in
savings for our clients by reductions in fines. The following
are some examples of our successes.
NJ Construction Contractor
- Applegate formulated an employee misconduct defense for a
trenching citation at an OSHA informal conference. Result - A
willful violation was downgraded to a serious violation.
Washington State Construction
Contractor - Based on documentation prepared by Applegate,
the firm's five of seven OSHA citations were vacated at an
informal OSHA conference.
Result - Original penalty of $11,600 reduced to $1,500.
NJ Storage Rack Installer - Applegate formulated an employee
misconduct defense for a repeat violation that carried penalties
of $56,000. Result - The repeat violation was downgraded
to a serious violation with a $49,000 reduction in the
penalty.
