Successes With OSHA and Legal Cases
In FY 2004, OSHA issued more than 86,708 violations and levied fines of more than $166 million. We have been highly successful in handling OSHA cases that have resulted in hundreds of thousands of dollars in savings for our clients by reductions in fines. The following are some examples of our successes.

NJ Construction Contractor - Applegate formulated an employee misconduct defense for a trenching citation at an OSHA informal conference. Result - A willful violation was downgraded to a serious violation.

Washington State Construction Contractor - Based on documentation prepared by Applegate, the firm's five of seven OSHA citations were vacated at an informal OSHA conference. Result - Original penalty of $11,600 reduced to $1,500.

NJ Storage Rack Installer - Applegate formulated an employee misconduct defense for a repeat violation that carried penalties of $56,000. Result - The repeat violation was downgraded to a serious violation with a $49,000 reduction in the penalty. more >
